List of Bills Slashing Tax Credits and Exemptions
The following bills have passed out of the Colorado House and are up for Senate hearings February 3 and 4 then second reading in the Senate by Friday, February 5

 

  • House Bill 10-1192: Sales and Use Tax of Standardized Software (Pommer/Heath) – Reverses the Colorado Department of Revenue’s practice of not charging sales tax on business software that is not delivered on a disk or other tangible medium.
  • House Bill 1190: Suspend Industrial Fuel Sales & Use Tax Exemption (Pommer/Heath) – suspends the exemption from state sales and use taxes for the storage, use or consumption of electricity, coke, fuel, oil, steam, nuclear fuel and gas utilized  in all industrial and manufacturing uses until mid-2012.
  • House Bill 10-1189: Eliminate Sales Tax Exemption for Direct Mail (Pommer/Heath)
  • House Bill 10-1191: Eliminate Candy and Soda Sales Tax Exemption (Pommer/Heath)
  • House Bill 10-1194: Eliminate Nonessential Articles Sales Tax Exemption (Ferrandino/Heath) - makes items such as napkins, cartons, bags, condiments and plastic ware that are provided to consumers at no charge taxable.
  • House Bill 1195: Suspend Agricultural Sales and Use Tax Exemption (Ferrandino/Heath) - For the next three years, sales and use taxes would be added to the sale, storage, use or consumption of ag compounds used in caring for livestock, as well as pesticides.
  • House Bill 10-1196: Eliminate Certain Cars Qualified for Tax Credit (Ferrandino/Heath) – Disqualifies vehicles that get more than 30 miles per gallon but less than 40 from the state income tax credit for alternative fuel vehicles through 2011.
  • House Bill 10-1198: Suspend Credit Alternative Minimum Tax (Ferrandino Heath) – Suspends the credit against state income taxes of 12% of the credit allowed for payment of maximum tax liability.
  • House Bill 10-1193: Sales Tax Out of State Retailers (Pommer/Heath) – Requires that any out-of-state retailer that has a referral relationship with an affiliate to collect sales taxes.
  • House Bill 10-1199: Net Operating Loss Deduction (Ferrandino/Heath) – Limits net operating losses to $250,000 for the next three years.

The following bills have not yet passed out of the Colorado House of Representatives

  •  House Bill 10-1200: Enterprise Zone Tax Credit Deferral (Hullinghorst/Heath) – Through 2013, taxpayers would be limited in the amount they can claim in enterprise zone tax credits to $250,000.
  • House Bill 10-1197: Reduce Conservation Easement Cap Amount (Ferrandino/Heath) – Reduces the maximum conservation easement tax credit from $375,000 to $135,000.
